Rules of the competition for Playstation 5 Slim gaming console - Mascot Name Selection
I. Organizer of the Competition
- The organizer and promoter of the competition for the Playstation 5 Slim gaming console – Mascot Name Selection (hereinafter referred to as the "Competition") is the company FONERGY s.r.o., ID No.: 293 08 607, with its registered office at Stojanova 1334, 686 01 Uherské Hradiště, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 73013 (hereinafter referred to as the "Organizer").
II. Location and Term of the Competition
- The competition takes place on the Organizer's Fonergy Facebook profile from November 3rd, 2025, to December 10th, 2025, inclusive.
III. Conditions for Participation in the Competition
- Every natural person over 15 years of age with a delivery address in the Czech Republic or the Slovak Republic may participate in the competition, excluding persons listed in the following paragraph 2 (hereinafter referred to as the "Competitor").

The following persons may not participate in the competition:
- employees of the Organizer, business partners of the Organizer or entities that are financially or personally connected to the Organizer, including their employees and collaborators;
- persons involved in the organization and execution of the competition;
- persons who are, in relation to persons referred to in points a. or b., close persons within the meaning of the relevant provisions of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code").
IV. Subject of the Competition
- The Competitor participates in the Competition by sharing the Organizer's post announcing the Competition on their Facebook profile and simultaneously writing their proposed name for the Organizer's mascot in the comments (hereinafter referred to as the "Competition Entry").
- Each Competitor may submit only one Competition Entry.

The Competition Entry must not:
- be in violation of the applicable legal regulations of the Czech Republic or the Slovak Republic;
- be contrary to good morals or generally accepted principles of decency;
- contain hidden advertising;
- contain elements of pornography, violence, or other inappropriate content;
- contain elements or parts to which third parties claim or may claim rights, in particular copyrights, trademark rights or designations of origin, and other intellectual property rights.
- The assessment of whether the Competition Entry complies with or violates paragraphs 1 to 3 rests solely with the Organizer. The Organizer is not responsible for an incomplete or otherwise flawed Competition Entry that cannot be used within the Competition due to a technical or other defect on the part of the Competitor or the Organizer.
- The Organizer reserves the right to exclude or not include a Competition Entry that does not meet the conditions of the Competition set forth in these rules, at any time, for any reason or without stating a reason, without the Competitor being entitled to any material or non-material compensation.
- By submitting a Competition Entry, the Competitor grants consent for their Competition Entry to be published on the Organizer's website, Facebook profile, and Instagram profile, and also grants consent for any modifications or potential changes or interventions to the Competition Entry for the purpose of its use in the Competition.
- The winning Competition Entry, and thus the Competitor, will be determined by a jury composed of representatives of the Organizer, and
V. Winner of the Competition and Prize
- The winning Competition Entry, and thus the winning Competitor, will be determined by a jury composed of representatives of the Organizer.
- The prize in the Competition is one Playstation 5 Slim gaming console (hereinafter referred to as the "Prize").
- In the event that multiple Competitors submit the same winning Competition Entry, i.e., propose the same name for the Organizer's mascot, and such entry is selected by the Organizer, the competition entry submitted earliest by a Competitor shall be considered the winning entry.
- The winning Competitor will be informed of the win by the Organizer on December 13th, 2025, via a message sent through Messenger on Facebook, and will be asked to provide their first name, last name, date of birth, email address, and delivery address for the Prize. If the winning Competitor does not provide the Organizer with the information specified in the previous sentence within 3 days of the Organizer sending the win notification, the winning Competitor forfeits the right to the Prize, and this Prize will be awarded by the Organizer to the second-place Competitor. The procedure described in the first and second sentences shall apply mutatis mutandis to the second-place Competitor and any subsequent Competitors.

The Prize:
- cannot be transferred or assigned to another Competitor or a third (non-competitor) party;
- cannot be paid out in cash, nor can any other non-cash compensation be provided for it;
- cannot be claimed through legal proceedings;
- may not be awarded by the Organizer to the winning Competitor if the Organizer has reasonable suspicion that the winning Competitor has violated or circumvented these rules, or at least attempted to do so; in such a case, the Organizer is entitled to disqualify the winning Competitor from the Competition without the winning Competitor being entitled to any material or non-material compensation.
VI. Protection of Personal Data
- By participating in the Competition, the Competitor grants the Organizer consent to process the provided or made accessible personal data to the extent that it is listed on their Facebook profile, and for the winning Competitor, to the extent specified in Article V, paragraph 4 of these rules, for the purpose of establishing contact with the Competitor and evaluating the Competition, for a period of 2 years from the date of consent. The Competitor has the right to withdraw their consent at any time by sending an email to info@fonergy.cz or by sending a letter to the Organizer's registered office or to their data box.
- Providing personal data is voluntary, but it is a necessary condition for participation in the Competition. All information on the processing and protection of personal data and the manner in which the Competitor, who has provided their personal data to the Organizer, can exercise their rights is available at https://fonergy.cz/ochrana-osobnich-udaju. The Organizer processes personal data in accordance with the principles and rules arising from legal regulations (especially Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data) and at the same time respects moral and ethical rules for the processing of personal data.
- By participating in the Competition, the Competitor agrees that the Organizer is entitled, in the event of the Competitor's victory, to use their first name, last name, and likeness free of charge in accordance with the provisions of Section 84 et seq. of the Civil Code, in the media (including the internet), promotional and advertising materials of the Organizer in connection with the presentation of this Competition, the announcement of the Competition winners, and the presentation of the Organizer.
VII. Final Provisions
- The Organizer reserves the right to make the final decision in all matters related to the organization and conduct of the competition, including its interruption, postponement, withdrawal, cancellation, or amendment of these rules. The Organizer is entitled to change these rules at any time during the Competition, i.e., including the methods of determining winners, the type of prize, and in exceptional cases, to cancel the competition.
- The Organizer does not anticipate that any copyrights will arise for the winning Competitor within the Competition, but in the event that this occurs, the winning Competitor gratuitously assigns to the Organizer the right to exercise all economic copyrights to the winning Competition Entry, or to any of its individual parts. The Organizer is entitled to exercise all economic copyrights exclusively in their own name and at their own expense, has the right to further assign the exercise of economic copyrights to the winning Competition Entry to third parties and to further assign them without limitation, and the winning Competitor, by submitting the Competition Entry, agrees to this. In the event that the provision in this paragraph is void and/or ineffective for any reason, and also for any reason the right to exercise the economic copyrights of the winning Competitor does not transfer to the Organizer by law, and to the extent that the winning Competitor does not themselves have the right to exercise the economic copyrights, the winning Competitor grants the Organizer an exclusive, geographically and materially unlimited license to the winning Competition Entry, limited in time to the duration of the economic copyrights to the winning Competition Entry, for all methods of use. The winning Competitor hereby agrees to the publication of the winning Competition Entry by the Organizer and by the person designated by them, and further agrees that the winning Competition Entry may be modified in any way, included in another work, and that the Organizer will be credited as its author. Furthermore, the winning Competitor agrees that the Organizer may grant all consents within this entire scope to another person or persons without limitation and allow these persons to grant the same consent further.
- By participating in the Competition, the Competitor expresses their consent to these rules and undertakes to abide by them. Any violation or circumvention of these rules by the Competitor, or an attempt to do so, is grounds for immediate disqualification of the Competitor from the Competition.

- These rules were issued by FONERGY s.r.o. on November 1st, 2025, effective from November 3rd, 2025.
